Terms of Use — F0K

1. Publisher
F0K is published by ABBAQ SAS, company number (SIREN) 850959552, 101 Rue de Sèvres, 75006 Paris, France ("we", "us"). By using F0K (the "App"), you accept these Terms.
2. The service
F0K is a social and safety app among friends, with two uses:
- NIGHTLIFE: you take a selfie with a person you've met and your private friend circle gives an opinion (GO / STOP / Hmm), with no free-text comments. It's an opinion meant for you, not a public rating of the person.
- KONFIDENCE: you let your trusted circle know where you are (approximate location), what time, and who you're with.
The App relies on ephemeral content (visible for 24 h) that is private (limited to the circle you choose).
3. Eligibility
You must be at least 18 to use F0K. By creating an account, you confirm you meet this requirement.
4. ⚠️ F0K is NOT an emergency service
F0K is not an emergency, security, or monitoring service, and does not replace the police, emergency services, or any professional protection system. If you are in danger, contact emergency services immediately (in France: 112 / 17 / 15). The safety features (timer, SOS, trip sharing) are community "best-effort" aids, with no guarantee of delivery or response.
5. Your account
You are responsible for the use of your account and for keeping your access confidential. Notify us of any unauthorized use.
6. Acceptable use
You agree not to:
- harass, threaten, defame, or harm others;
- post illegal, hateful, violent, or sexual content involving minors;
- impersonate others;
- collect or misuse other users' data;
- circumvent security or disrupt the service.
7. Image rights and consent of the photographed person
You are solely responsible for the photos and information you share. In NIGHTLIFE mode, the photo is a selfie taken with the person (present and aware), and the App collects the consent of the photographed person themselves: before any send, a dedicated screen informs them of the purpose (collecting your private circle's opinion), the data controller (ABBAQ SAS) and their right to object (GDPR art. 13-14), then asks them to accept or decline. Without their consent, sending is blocked. A timestamp of this consent is kept as proof. This does not relieve you of your responsibility: you warrant that you hold the necessary rights and indemnify us against any third-party claim. The photographed person may withdraw their image at any time, with immediate effect (see section 7 bis).
7 bis. Reporting and removal of content
Any user or third party may report content via the in-app report button or by email to abuse@f0k.app. Any photographed person can obtain immediate removal of their image — deletion without delay, without waiting for the 24 h expiry (dedicated image-rights procedure). We also review reports and remove, as soon as possible (target: under 24 h), any other manifestly unlawful content. These provisions are in the spirit of the EU Digital Services Act (DSA).
7 ter. LCEN/DSA notification procedure
Anyone wishing to report unlawful content may do so via the report button directly on the NIGHTLIFE card received, or by email to abuse@f0k.app.
To be processed with priority, a notification should include: (i) the nature of the alleged unlawful content and the relevant legal provision; (ii) a description of the content in question; (iii) the contact details of the person making the notification.
Processing timelines: removal of a photographed person's image (image rights): immediate. Manifestly unlawful content (sexual, violent, involving a minor): target < 24 h. Other reports: target < 72 h.
Metadata enabling identification of a content author (user ID, timestamp, file path) is retained for 12 months from the date of sending, including after automatic deletion of the content, to allow response to any judicial requisition (LCEN art. 6-II).
7 quater. Moderation decisions — reasons and appeals
When ABBAQ removes content or suspends an account, the user is informed with a statement of the reason (category of violation found or alleged).
Right to appeal: any user may contest a decision by writing to abuse@f0k.app, stating the decision contested and the reasons why they consider it unfounded. ABBAQ responds within 14 business days.
Limit of automated moderation: the AI moderation filter does not claim to detect all possible unlawful content. It is a preventive technical security measure; all notifications received are subject to human review.
8. Content & license
You retain ownership of your content. You grant us a limited license, strictly necessary to host and display your content within your circle, for the ephemeral duration provided (24 h), solely to provide the service.
9. F0K+ subscription (where applicable)
Some features may be offered via a paid subscription ("F0K+"). Billing, renewal, and cancellation are handled by the app store (App Store / Google Play) under their terms. Prices are shown in the App. Statutory withdrawal rights apply where required by law.
10. Availability & liability
The App is provided "as is". We do not guarantee uninterrupted or error-free availability. To the extent permitted by law, we are not liable for indirect damages, nor for the consequences of using the safety features as a substitute for an emergency service (see section 4).
11. Suspension / termination
We may suspend or close an account for breach of these Terms. You may delete your account at any time; your data is then handled in accordance with the Privacy Policy.
12. Changes
We may amend these Terms. For significant changes, we will notify you in the App.
13. Governing law & disputes
These Terms are governed by French law. Failing amicable resolution, disputes fall under the competent courts, subject to applicable consumer-protection rules. Consumer mediation is available.
